Terms of Use

Applies to: freetimewny.com, the Freetime mobile application, and any other websites, apps, or services operated by Freetime WNY (together, the “Services”).

1. Acceptance of Terms

By accessing or using the Services, you agree to be bound by these Terms of Use (“Terms”). If you do not agree, do not use the Services.

Freetime is currently operated as a DBA of an individual owner (“Freetime WNY,” “Freetime,” “we,” “us,” or “our”), pending formation of a formal business entity.

2. Eligibility

The Services are intended for general audiences. You must be at least 13 years old to create an account. If you are under the age of majority in your state, you may only use the Services with the involvement of a parent or guardian.

3. Description of the Services

Freetime helps people discover live music, events, festivals, venues, and performers in the Rochester, Finger Lakes, and Buffalo, NY region. Event information is gathered from a variety of sources, including venue websites, ticketing platforms, and public listings, and may also be entered manually.

Event details (dates, times, prices, lineups) can change without notice, and information gathered from third-party sources may occasionally be incomplete, outdated, or inaccurate. Always confirm details directly with the venue or ticketing platform before making plans or purchasing tickets.

4. Accounts

You create an account by signing in with Google. You're responsible for maintaining the security of the Google account linked to Freetime and for all activity that occurs under your Freetime account. Notify us right away if you believe your account has been accessed without authorization.

We may suspend or terminate your account if we reasonably believe you've violated these Terms.

5. Acceptable Use

You agree not to:

  • Use the Services for any unlawful purpose or in violation of any applicable law
  • Scrape, crawl, or harvest data from the Services using automated means, except as permitted by our robots.txt or with our prior written consent
  • Interfere with or disrupt the integrity or performance of the Services
  • Attempt to gain unauthorized access to the Services, other accounts, or related systems
  • Impersonate any person or entity, or misrepresent your affiliation with a person or entity
  • Post or transmit content that is unlawful, harassing, defamatory, obscene, or infringes on another's rights
  • Use the Services to send unsolicited advertising or spam

We reserve the right to remove content or restrict access to the Services for anyone who violates these Terms.

6. User Content

Certain features let you generate content within the Services — for example, marking events as “Interested” or “Going,” following acts or venues, adding personal notes, or tagging festival priorities (“User Content”).

You retain ownership of your User Content. By submitting User Content that you choose to make visible to other users (such as a public event status), you grant Freetime a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content solely for the purpose of operating and promoting the Services. Personal notes you keep private remain visible only to you unless you choose to share them.

You're solely responsible for your User Content and confirm you have the right to share it.

7. Third-Party Ticketing and Links

Freetime does not sell tickets, process payments, or act as a party to any ticket purchase. Links to purchase tickets take you to third-party platforms (such as Ticketmaster, AXS, Tixr, Eventbrite, or a venue's own site), which are governed by that platform's own terms and policies. Any purchase, refund, exchange, or dispute related to a ticket is solely between you and that third party.

Freetime is not responsible for the accuracy, availability, or conduct of any third-party site, venue, or ticketing platform linked from the Services.

8. Intellectual Property

The Services — including their design, text, graphics, logos, and underlying software — are owned by Freetime or its licensors and protected by intellectual property laws. Event, venue, act, and performer information displayed on the Services may be sourced from third parties and remains subject to those parties' rights.

You may not copy, modify, distribute, sell, or lease any part of the Services or their content without our prior written permission, except as expressly permitted by these Terms (e.g., your own User Content).

9. Advertising and Paid Features

The Services may in the future display advertising. We plan to offer a paid, ad-free version of the app as an alternative to viewing ads. If and when paid subscriptions launch, additional terms covering billing, renewal, and cancellation will be presented to you at the time of purchase and will supplement these Terms.

10. Disclaimers

THE SERVICES AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT EVENT INFORMATION IS ACCURATE OR CURRENT.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FREETIME AND ITS OWNER(S) WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, ARISING FROM YOUR USE OF (OR INABILITY TO USE) THE SERVICES — INCLUDING ANY RELIANCE ON EVENT INFORMATION OR ANY TRANSACTION WITH A THIRD-PARTY TICKETING PLATFORM OR VENUE — EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE EXTENT ANY LIABILITY CANNOT BE DISCLAIMED, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICES IS LIMITED TO THE AMOUNT YOU PAID FREETIME IN THE 12 MONTHS BEFORE THE CLAIM AROSE.

12. Indemnification

You agree to indemnify and hold harmless Freetime and its owner(s) from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Services, your User Content, or your violation of these Terms.

13. Termination

You may stop using the Services and delete your account at any time. We may suspend or terminate your access to the Services at any time, with or without notice, for conduct that we believe violates these Terms or is otherwise harmful to other users, us, or third parties.

14. Changes to These Terms

We may update these Terms as the Services grow. We'll post the updated Terms here with a new “Last updated” date, and for material changes we'll provide more prominent notice (such as an in-app or email notification). Continued use of the Services after changes take effect means you accept the updated Terms.

15. Governing Law and Disputes

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles. Any dispute arising from these Terms or the Services will be resolved exclusively in the state or federal courts located in Monroe County, New York, and you consent to personal jurisdiction there.

16. Miscellaneous

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect. Our failure to enforce any provision is not a waiver of that provision. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Freetime regarding the Services.
